New Hampshire Supreme Court Upholds Casella’s Landfill Expansion Permit


SEATTLE (Scrap Monster): The state’s top court, in a ruling, has stated that the permit to Casella Waste Systems to expand the Bethlehem, New Hampshire, landfill was issued legally. The Supreme Court reversed a prior decision made on an appeal from the Conservation Law Foundation (CLF).

It must be noted that Casella had received permit for the first time in 2020. However, the issuance of the permit was challenged by the CLF, stating that the company failed to meet necessary state public benefit requirements. The New Hampshire Waste Management Council too joined CLF, saying that New Hampshire would not require the extra landfill space until 2026.

Commenting on the development, John Casella, CEO noted that the decision recognizes the ongoing need for disposal capacity in the state. The company has already constructed the Bethlehem expansion and has begun accepting waste based on the conditions of the 2020 permit, he said. Incidentally, Casella operates the landfill through its subsidiary North Country Environmental Services.

Meantime, the company is said to be moving ahead with its plans to open the Granite State landfill in Dalton.
